Drive Cleaning, Inc., Terms and Conditions of Drive Cleaning Service:

Drive Cleaning, Inc. services are provided subject to you, ("Customer"). Compliance and acceptance with the terms and conditions set forth below. Please read the following agreement carefully. "Customer" use of any of Drive Cleaning, Inc.'s services indicates an agreement to be bound by the terms and conditions set forth below. This agreement is strictly between Drive Cleaning, Inc. and the Customer and does not in any way constitute or imply any relationship with any other parties. As a condition to using any of Drive Cleaning, Inc.'s services, and for the mutual benefit of both Drive Cleaning, Inc. and the Customer, the undersigned ("Customer") agrees to the following terms and conditions:

Delivery Schedule: Pick ups and deliveries will occur Monday thru Friday only and not on weekends or selected holidays. Drive Cleaning, Inc. reserves the right to determine the pick-up and drop-off times at its own discretion and reserves the right to reschedule such times upon prior notice to Customer.

Pick Up and Delivery, Procedure and Terms: Customer agrees to include only (i) washable items in the "wash and fold" bag and(ii) items that can be dry-cleaned, pressed, or special care items in the "dry-clean & press" bag. If Customer does not have a “Drive Cleaning” bag available, Customer may leave clothing in any available bag. Bags will not be returned to Customer. Customer is responsible for all damage to clothing, cleaning machines, or anything else when caused by any items present in the laundry bags. It is the Customer's responsibility to deliver the dirty laundry bags to a Drive Cleaning, Inc. representative at the appointed location and time. The schedule will be communicated directly to the Customer.

Missed Delivery or Pick Up: In the event that a Customer misses a pick up or delivery there will not be a missed delivery charge. Customer may call Drive Cleaning to set up “on call” additional pickup dates, however a $15 minimum applies to any “on call” pickups. Drive Cleaning, Inc. is not responsible for and shall not pay for, any loss, damage or theft of items left unattended for pick up-or drop-off, whether left by Customer or Drive Cleaning, Inc.

Payment: Customers will be billed on a monthly basis via credit card or debit card. Drive Cleaning reserves the right to change billing terms at any time without prior notice. Drive Cleaning, at its sole discretion, may choose to bill customer before delivery of each order, rather than on a once per month basis. Customer will not be charged for a laundry bag issued to them at the time of initial service. Customers must maintain a valid and current credit card or debit card number on file. Customer hereby grants to Drive Cleaning, Inc. the right to charge its credit card or debit card for any such charges for any given month or term, consents to the billing of its credit card or credit card for such charges, and agrees to pay for any excess services provided. Such overages will be calculated by using the standard and usual non-bulk, retail rate charged for the particular service provided.

Specialty Care Sheets: Drive Cleaning, Inc. will post a specialty care sheet on its website. It is the Customer's responsibility to print and complete a copy of the form and place the form in their laundry bag before the time of service, should the customer have any special care items or any special requests. If a special request form is not present in the Customer's laundry bag before the time of processing, then Drive Cleaning, Inc. reserves the right to not clean that item.

Garment Care and Missing or Damaged Goods: Drive Cleaning, Inc. will use reasonable efforts to try to ensure that its cleaning service maintains a high quality service. Drive Cleaning, Inc. accepts no liability for damage due to normal cleaning of items without care instructions and accepts no liability for items treated in accordance with the care labels or other instructions provided. Drive Cleaning, Inc. accepts no liability for "special care" items that require special attention to be cleaned or that do not have care instructions. Drive Cleaning, Inc. reserves the right to refuse cleaning any garment. Drive Cleaning, Inc. does not guarantee removal of all stains. Drive Cleaning, Inc. will have its cleaning service re-clean items that were not properly cleaned and not yet worn since they have been cleaned. Drive Cleaning, Inc. is not responsible for loss of or damage to any personal or non-cleanable items left in the clothing or bags such as money, jewelry, or anything else. Customer agrees not to leave such items in its clothing or in the delivery bags. Although Drive Cleaning, Inc. is not liable for damage to or loss of clothing due the fault of the third party cleaners or service providers, if Drive Cleaning, Inc. at its sole discretion desires to, Drive Cleaning, Inc. will reimburse Customer for lost or damaged clothing in an amount to be determined by Drive Cleaning, Inc.. "Customer must notify Drive Cleaning, Inc. within 14 days of receipt of a delivery of any lost or damaged items from that particular delivery, failure to do so constitutes waiver of a claim for any lost or damaged items from that delivery.

Service Providers/Disclaimer of Certain Liabilities: Drive Cleaning, Inc. or its associates will deliver Customer items to and from a dry-cleaning service of Drive Cleaning, Inc.'s choice. Drive Cleaning, Inc. reserves the right to utilize any outsourcer, vendor, or outside service provider, for any service, at its sole discretion without notice to Customer.

Disclaimer: Drive Cleaning, Inc.'s liability under this agreement shall be limited to general money damages in an amount not to exceed the charges for the term of service paid by Customer in the term under which the damages are alleged to have occurred. This liability shall be the extent of Drive Cleaning, Inc.'s liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute Customers exclusive remedy. In no event will Drive Cleaning, Inc. be held liable or be responsible for any consequential, special, indirect, incidental, or punitive loss or damages whether or not Drive Cleaning, Inc. knew or should have known of the likelihood of any loss or damages. Drive Cleaning, Inc. disclaims all warranties express or implied with respect to the services rendered under this agreement.

Interior Access To Property For Delivery, Hold Harmless/Indemnification. If access to the Customer's property for delivery of clothing and other specialty items is allowed; Customer hereby waives any and all claims against Drive Cleaning, Inc. and its officials, agents, and employees for damage to or loss of use of property which arise as a result of Customer allowing access to his or her property for the purpose of delivering clothing and other specialty items. Customer agrees to indemnify Drive Cleaning, Inc. and its officials, agents, and employees for any bodily or personal injuries they may incur arising as a result of Customer allowing access to his or her property for the purpose

Entire Agreement/Choice of Law: This agreement and any documents referred to herein constitute the complete, exclusive, and entire agreement between the parties, may not be modified except in writing signed by both parties, and shall be governed by the state in which it operates.
