Drive Cleaning, Inc. (“Drive Cleaning”), Terms and Conditions of Service:
The following terms and conditions govern your use of Drive Cleaning services. As a condition to using any of Drive Cleaning’s services, Drive Cleaning and the undersigned customer (“Customer”) agree to the following terms and conditions:
Delivery Schedule: Drive Cleaning pick-ups and deliveries will occur Monday through Saturday only and not on Sundays or holidays. Drive Cleaning reserves the right to determine pick-up and drop-off times at its discretion and reserves the right to reschedule such times upon prior notice to Customer. Drive Cleaning provides customers with pickup and delivery days only, and not specific pickup and delivery times. Customer must have items ready to be picked up or be able to accept deliveries starting at 7:00 am on their scheduled service days.
Pick-Up and Delivery: Procedure and Terms: Customer agrees to include only (i) washable items in the “wash and fold” bag provided by Drive Cleaning and (ii) items that can be dry-cleaned, pressed, or cleaned in accordance with any instructions or requests provided by Customer in the “dry-clean & press” bag provided by Drive Cleaning. If Customer does not have a “Drive Cleaning” bag available, Customer may leave clothing for pick-up in any available bag. Customer provided bags will not be returned to Customer. It is Customer’s responsibility to deliver the dirty laundry bags to a Drive Cleaning representative at the appointed location and time. Drive Cleaning will communicate the pick-up/delivery schedule to Customer.
Missed Delivery or Pick-Up: . Customer may contact Drive Cleaning to arrange “on call” additional pick-up dates. Drive Cleaning is not responsible for and shall not pay for, any loss, damage or theft of items left unattended for pick-up-or drop-off, whether left by Customer or Drive Cleaning.
Payment: Customers will be billed on a monthly basis by credit or debit card. Drive Cleaning reserves the right to change billing terms at any time without prior notice. Drive Cleaning may bill customer before delivery of each order. If Drive Cleaning is unable to collect payment, Drive Cleaning reserves the right to withhold delivery until such time as payment is made for all services performed. Drive Cleaning bags provided to customers for use by Drive Cleaning are the property of Drive Cleaning and must be returned to Drive Cleaning if Customer decides to no longer use the service. Customer may be charged a fully refundable deposit (the “Bag Deposit”) for bags issued to them during service. In the event that Customer terminates Drive Cleaning services, Customer must return any Drive Cleaning bag(s) within sixty (60) days of their last use of Drive Cleaning services. In the event that Customer does not return the Drive Cleaning bags, Customer forfeits its Bag Deposit and the bags become the property of Customer. Customers must maintain a valid credit or debit card number on file with Drive Cleaning. Customer hereby authorizes Drive Cleaning to charge its credit or debit card for all charges for any given month or delivery. Customer consents to the billing of its credit or debit card for such charges, and agrees to pay for all services. If a client’s bill remains unpaid for more than thirty (30) days from the billing date, Drive Cleaning will add a service charge of one and one-half percent (1.5%) each month to the unpaid balance. Customer agrees to be responsible to pay all of our reasonable costs of collecting any unpaid balances.
Special Care Instructions: In order to request special care for any garment, including leather, suede, fur, satin, area rugs, comforters, and draperies, Customer must include such special care instructions in the Drive Cleaning “dry-clean & press” bag or, if the bag contains more than one item, attach the special care instructions to the item(s) subject to the special care instructions. If a special request is not present in Customer’s laundry bag before the time of processing, Drive Cleaning reserves the right to clean that item in its sole discretion.
Garment Care and Missing or Damaged Goods: Drive Cleaning reserves the right to refuse to clean any garment. Drive Cleaning does not guarantee removal of all stains. Drive Cleaning will re-clean items that were not completely cleaned and not yet worn since cleaning. Drive Cleaning is not responsible for loss of or damage to any personal or non-cleanable items left in the clothing or bags.. Drive Cleaning is not liable for damage to or loss of clothing due to any third party cleaners or service providers. Customer must notify Drive Cleaning within 14 days of receipt of a delivery of any lost or damaged items from that particular delivery. Failure to do so constitutes waiver of a claim for any lost or damaged items from that delivery.
“Wash and Fold” Items: Customer acknowledges that Drive Cleaning does not catalogue each individual item included within “wash and fold” loads, but instead accounts for “wash and fold” loads received from Customer by weight. Drive Cleaning is not responsible for the loss of “wash and fold” items.
Service Providers/Disclaimer of Certain Liabilities: Drive Cleaning reserves the right to utilize any outsourcer, vendor, or outside service provider, for any service, at its sole discretion without notice to Customer.
Disclaimer: Drive Cleaning’s liability is solely limited to money damages in an amount not to exceed ten times the charges for the cleaning of the garment at issue. Customer waives any consequential, special, indirect, incidental, or punitive damages from Drive Cleaning, irrespective of whether Drive Cleaning knew or should have known of the likelihood of any loss or damages. Customer is responsible for all damage to clothing, cleaning machines, or anything else when caused by any items present in the laundry bags. Drive Cleaning bears no responsibility for any damages arising from the regular cleaning of special care items when Customer fails to provide special instructions regarding those special care items. Drive Cleaning shall have no liability for damage due to normal cleaning of items without care instructions and no liability for items treated in accordance with the care labels or other instructions provided. Drive Cleaning shall have no liability for trimmings, buckles, beads, buttons, belts, and sequins.
Interior Access To Property For Delivery, Hold Harmless/Indemnification: If access to the Customer’s property for delivery of clothing and other specialty items is allowed; Customer hereby waives any and all claims against Drive Cleaning and its agents and employees for damage to or loss of use of property that arise as a result of Customer allowing access to its or other’s property for the purpose of delivery. Customer agrees to indemnify and hold harmless Drive Cleaning and its agents, and employees for any bodily or personal injuries arising from Customer allowing access to its property to Drive Cleaning.
Entire Agreement/Choice of Law: These terms and conditions may not be modified except in writing signed by both parties, and shall be governed by the laws of the State of Illinois.
Arbitration: All disputes and differences of any kind arising under these terms and conditions or arising between Customer and Drive Cleaning, including the existence or continued existence of this Agreement and the arbitrability of a particular issue that the parties cannot settle amicably, shall be submitted to binding arbitration. The arbitration shall be conducted in Chicago, Illinois and shall finally be settled in accordance with the Rules of Arbitration of the American Arbitration Association by one arbitrator appointed in accordance with the above mentioned rules. The arbitrator shall be allowed to apportion fees according to the ruling.
The decision of the arbitrator shall be final and binding upon the parties and may be enforced in any court of competent jurisdiction, and no party shall seek redress against the other in any court or tribunal except solely for the purpose of obtaining execution of the arbitral award or of obtaining a judgment consistent with the award. Any costs so incurred shall be paid by the losing party. In the event of legal proceedings, Customer agrees to waive its right to a trial by jury.
Ownership of This Website: This website is owned and operated by Drive Cleaning. All of the content featured or displayed on this website, including, but not limited to, text, graphics, photographs images, moving images, sound, illustrations, and software (“Content”), is owned by Drive Cleaning, its licensors and its content providers.
All elements of Drive Cleaning websites, including, but not limited to, the general design and the Content, are protected by copyright, moral rights, trademark and other laws relating to intellectual property rights. No portion or element of this website or its Content may be copied or retransmitted via any means and this website, its Content, and all related rights shall remain the exclusive property of Drive Cleaning or its licensors unless otherwise expressly agreed. You shall indemnify Drive Cleaning, its subsidiaries, its affiliates, and licensors against any losses, expenses, costs or damages incurred by any or all of them as a result of your breach of the terms of this Agreement or your unauthorized use of the Content and related rights.
Disclaimers: DRIVE CLEANING WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES. CUSTOMER ASSUMES THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION DUE TO YOUR USE OF THIS WEBSITE.
Except as specifically stated in these Terms and Conditions of Use or elsewhere on this website, or as otherwise required by applicable law, neither Drive Cleaning nor its directors, employees, licensors, content providers, affiliates or other representatives will be liable for damages of any kind (including, without limitation, lost profits, direct, indirect, compensatory, consequential, exemplary, special, incidental, or punitive damages) arising out of your use of, your inability to use, or the performance of this website or the Content whether or not we have been advised of the possibility of such damages.
Drive Cleaning uses reasonable efforts to ensure the accuracy, correctness and reliability of the Content, but we make no representations or warranties as to the Content’s accuracy, correctness or reliability.
